Getman, Sweeney & Dunn (GSD) filed this case in federal court on behalf of a group of Servers who worked at Buffets restaurants (Ryan’s, HomeTown Buffet, Old Country Buffet, Fire Mountain, and Tahoe Joe’s). The Servers claimed that they were not paid the full minimum wage for non-tip-related or non-serving-related work. They also claimed that they were not paid for off-the-clock work. Buffets declared bankruptcy in March of 2016 while this case was proceeding. All of the proceedings were put on hold while the case was moved to Federal Bankruptcy Court in Texas. GSD continued to press Servers’ claims in the bankruptcy court and in February 2017 notice was mailed to eligible servers of their ability to bring their claims in bankruptcy. In April of 2017, GSD filed a “Proof of Claim” for more than 1,600 servers who joined the case. The Bankruptcy Court then ordered each server to return a “Confirmation of Loss” questionnaire to further evaluate the claims. These forms were mailed out in October 2017 and the deadline for servers to respond was February 2018. The Court dismissed any server’s claims if a Confirmation of Loss Statement was not received by the February 2018 deadline. The surviving claims against Buffets were settled in two separate settlements, the Trust Settlement and the Reorganized Debtors Settlement, because the Bankruptcy Plan provides that the two entities pay for different types of claims. The Bankruptcy Court for the Western District of Texas approved both settlements. This website addresses the Trust Settlement, which is for claims for the period between July 18, 2012 and September 8, 2015 for servers who worked at a Buffets restaurant, who joined this case by submitting a consent to sue, and from whom we received a Confirmation of Loss Statement by the deadline set by the Court.
